The property will need to be transmitted into the name of the Personal Representative of the deceased tenant to be sold.
OR
If the property is the subject of a specific bequest then it can be transmitted directly to the beneficiary then sold if both tenants agree.
YES – Probate
Once Probate is obtained lodge a Form 5 Transmission Application with DNRM for ½ share. Once Probate is obtained lodge a Form 6 & 24A Transmission Application with DNRM for ½ share.
No- Probate
Lodge a Form 5A Transmission Application with DNRM for ½ share along with the original Will and Death Certificate. Lodge a Form 6 & 24A Transmission Application with DNRM for ½ share along with the original Will and Death Certificate.
